Utah Division of Real Estate rules prohibit licensed Transaction Coordinators from providing licensed services to any agent outside of their own brokerage and for having payment for those services contingent on the sale of a home. Licensed or not TC’s working outside of their own Brokerage are considered Personal Assistants and restricted in the services they can provide (See Utah Rule 162-2f-401g).
The only way a licensed TC can provide licensed services outside of their own Brokerage is through a Co-Listing/Co-Brokerage Agreement establishing agency that is signed by all parties (Brokers/Agents/Buyers and Sellers). Licensees who advertise/provide licensed services without the appropriate agreement in place and the Brokers/Agents who use them can all be subject to disciplinary action against their Real Estate licenses (See Utah Rule 162-2f-401 (3)(12-16)).
